Welcome to PicsPics Party (the Service), available at https://picspics.party and any associated subdomains, web apps and mobile interfaces.

The Service is operated by Say I Do Wedding Planning Pty Ltd, trading as PicsPics Party ("PicsPics Party", "we", "us", "our").

These Terms & Conditions ("Terms") form a binding agreement between you and PicsPics Party. Please read them before creating an account, uploading photos or otherwise using the Service. By accessing or using the Service you agree to these Terms. If you don't agree, please don't use the Service.

PicsPics Party is a photo-sharing service. We don't provide wedding websites, RSVP tools, guest-list management, registries or printed goods.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a Host account. Guests under 18 may upload Content only with the permission of a parent or legal guardian; it is the Host's responsibility to ensure their event is age-appropriate and that any minors uploading have appropriate consent.

When creating an account you agree to provide accurate, current and complete information, and to keep it up to date. You are responsible for all activity that occurs under your account and for keeping your login credentials secure. Notify us promptly at privacy@picspics.party if you believe your account has been accessed without authorisation.

We may refuse, suspend or terminate any account at our discretion where we reasonably believe you have breached these Terms, acted unlawfully, or used the Service in a way that risks harm to other users, third parties or us.

3. The Service

PicsPics Party lets a Host create an Event, share it with Guests via a QR code or link, and collect photos and videos uploaded by those Guests in one place. The Host can view, download, share and manage Content within the limits of their plan.

We may add, change, remove or improve features at any time. Where a change materially reduces the functionality of a paid plan you've purchased, we'll give you reasonable notice and, where appropriate, a pro-rata refund.

The Service relies on third-party infrastructure (e.g. cloud storage, image processing). We use reasonable efforts to keep things running but don't guarantee uninterrupted or error-free operation.

4. Hosts and Guests — who is responsible for what

The Host is the controller of their Event. The Host decides who to share the QR code or link with, sets Event-level settings we make available (such as privacy and moderation options), and is responsible for:

Guests are responsible for the Content they upload. By uploading, a Guest confirms they have the right to share that Content and that it doesn't breach these Terms.

PicsPics Party is a tool. We don't host weddings, we don't attend events, and we are not a party to any arrangement between a Host and their Guests.

5. Your Content — ownership and licence

You keep ownership of your Content. Uploading to PicsPics Party does not transfer copyright or any other rights to us.

To run the Service, you grant PicsPics Party a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, copy, transmit, reformat, resize, create thumbnails of, display and otherwise process your Content for the purposes of:

This licence exists for as long as the Content is stored on the Service and for a reasonable period afterwards to allow for backup expiry and deletion from our systems.

We will not sell your Content, use it to train third-party AI models, share it with third parties for marketing, or display it in our own marketing without your separate, express written consent. If we'd like to feature an Event as a case study or testimonial, we'll ask.

6. Acceptable use

You agree not to use the Service to upload, share, transmit or store Content, or take any action, that:

We may, but are not obliged to, monitor Content and may remove or restrict access to any Content we reasonably believe breaches these Terms, without notice.

7. Privacy

Our Privacy Policy explains what personal information we collect, how we use it, and the rights you have. By using the Service you consent to that policy.

Guests should be aware that photos uploaded to an Event are visible to the Host and (depending on Event settings the Host has chosen) to other Guests with access to the Event. Please don't upload anything you wouldn't want those people to see.

8. Pricing, plans and billing

The Service is currently available without charge during our launch period. Some features, storage limits, retention periods or higher-tier plans may be introduced as paid offerings in future. We'll give Hosts reasonable notice before any feature you currently use without charge becomes a paid feature, and you'll have the option to discontinue use rather than pay.

Where paid plans are introduced:

We may change pricing at any time. Any change to fees for a paid plan you've already purchased will take effect at the start of your next billing period and we'll give you reasonable notice.

9. Storage, retention and deletion

Content uploaded to an Event is stored on our systems for the period stated for the Host's plan at the time the Event was created, or — for free-tier Events — for the retention period stated on our pricing page from time to time.

You can delete your own Content, and Hosts can delete their Event, at any time through the Service. Once deleted, Content is removed from active systems immediately and from backups within a reasonable period.

We strongly recommend Hosts download a copy of their Event's Content before any retention period ends. We are not liable for Content that is lost because it was not downloaded in time, except to the extent required by law.

If your account is inactive for a prolonged period, or your plan expires and is not renewed, we may delete Events and Content after giving you reasonable notice by email.

10. Intellectual property in the Service

The Service itself — including the PicsPics Party name, logo, branding, software, design, code, layout, text and graphics (excluding user Content) — is owned by us or our licensors and is protected by copyright, trade mark and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose, subject to these Terms. No other rights are granted.

11. Reporting copyright infringement

If you believe Content on the Service infringes your copyright, please contact privacy@picspics.party with:

1. a description of the copyrighted work you say has been infringed;

2. the specific URL or Event where the infringing material appears;

3. your name, address, phone number and email;

4. a statement that you have a good-faith belief the disputed use is not authorised by the copyright owner, its agent or the law;

5. a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf; and

6. your electronic or physical signature.

We respond to valid copyright notices in line with the Digital Millennium Copyright Act (DMCA) for users in the United States, and equivalent processes for users in other jurisdictions. We may remove or disable access to material we reasonably believe infringes copyright, and may suspend or terminate accounts of repeat infringers.

Knowingly making a false claim of infringement can expose you to liability.

12. Third-party services and links

The Service may interoperate with or link to third-party services (such as cloud storage providers, payment processors, or sites you choose to share Events to). We don't control those services and aren't responsible for their content, availability, security or practices. Your use of any third-party service is governed by that third party's own terms.

13. Warranties and disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, secure, free of viruses, or that Content will be permanently stored or recoverable.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), the UK Consumer Rights Act 2015, or any other law that cannot be lawfully excluded. Where our liability for breach of a non-excludable guarantee can be limited, our liability is limited (at our option) to re-supplying the Service or paying the cost of having it re-supplied.

14. Limitation of liability

To the maximum extent permitted by law, PicsPics Party (and our officers, employees, contractors and licensors) will not be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, opportunity, data, or Content, however arising — whether in contract, tort (including negligence), under statute or otherwise — even if we have been advised of the possibility of those damages.

Our total aggregate liability to you arising out of or in connection with the Service and these Terms is limited to the greater of:

Some jurisdictions don't allow the exclusion or limitation of certain warranties or liabilities. In those places, the exclusions and limitations above apply only to the extent permitted by law.

You agree to indemnify and hold harmless PicsPics Party and our related entities, officers, employees and contractors from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or related to:

16. Suspension and termination

You can stop using the Service and close your account at any time by deleting your account through the Service or by emailing privacy@picspics.party.

We may suspend or terminate your access to the Service, or remove any Content, at any time if we reasonably believe you have breached these Terms, used the Service unlawfully, or if continued provision exposes us or other users to risk. Where reasonable, we'll give notice and an opportunity to fix the problem first.

On termination, your right to use the Service ends, and we may delete your Content and account data in line with our retention practices. Sections that by their nature should survive termination (including ownership, licence grants for Content already shared, disclaimers, limitations of liability, indemnity and dispute resolution) will continue to apply.

17. Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the revised Terms here and update the "Effective date" above. Where changes are material, we'll let Hosts know by email or in-product notice before they take effect.

Your continued use of the Service after the effective date of the revised Terms means you accept the changes. If you don't accept them, please stop using the Service.

18. Governing law and disputes

These Terms are governed by the laws of South Australia, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of South Australia and the federal courts of Australia.

If you are a consumer resident in another country (including the United Kingdom or the European Union), you also have the benefit of any mandatory protections under the law of your country of residence, and nothing in these Terms removes those protections.

Before starting any formal proceeding, please contact us at privacy@picspics.party and give us a reasonable opportunity to resolve the issue with you in good faith. Most things can be sorted out by email.
